Our client was under investigation for solicitation of prostitution, where the supposed prostitute was actually an undercover police officer. Based on the client’s recollection of the facts, attorney Ryan Garry called the prosecutor and convinced him that the case would not survive a Florence motion to dismiss for lack of probable case, based on the fact that police “jumped the gun” on the arrest and would be unable to prove one of the statutory elements of the crime. Prosecutor declined charging.
