Ryan’s client was facing a mandatory minimum commitment to prison after being charged with a firearm possession case (felon in possession). In other words, the law states that Ryan’s client should have gone to prison for at least 60 months absent extraordinary circumstances. Ryan filed a number of detailed sentencing motions and memorandums, and stretched the case out for 2 years. At the sentencing hearing, the judge, with strong opposition from the government, granted Ryan’s Motion for a Downward Dispositional Departure to Probation, executing no prison time, no jail time, no sentence to serve, and no real consequences whatsoever. Ryan’s client walked out of the courtroom with his family instead of the back of the courtroom in handcuffs and off to prison for five years.
