At the contested omnibus hearing, a Sherburne County judge granted Ryan’s motions to (1) reduce charges to Fourth Degree Misdemeanor because the State unlawfully enhanced the DWI charges to a Gross Misdemeanor level and (2) order the State to produce the Source Code to the Intoxilyzer 5000.
