Ryan’s client was drunk when he and his wife got onto his motorcycle, and later into a motorcycle accident. While he sustained minor injuries, his wife died. The homicide case lasted two years from start to finish. At Sentencing, over strenuous objection from the prosecutor and other witnesses at the sentencing hearing, the Judge granted Ryan’s motion for a Downward Dispositional Departure from the presumptive 41-57 month prison sentence, and imposed a probationary sentence.
