The firm client was charged with a criminal Domestic Assault charge, with a criminal history that complicated the case. Ryan worked with another attorney who represented the alleged victim in the case. Ryan filed motions to dismiss the charges for lack of probable cause and to suppress the client’s statements to law enforcement. Shortly before the motion hearing the prosecutor in the case offered a plea deal called a “Continuance for Dismissal (CWOP)” which means the client never had to plead guilty, never had to admit the facts of the case or accept any responsibility whatsoever. Rather, the case will be dismissed in all regards after the short unsupervised probationary terms. Next to an outright dismissal, there is no better result in a criminal case than a CWOP.
