Our client was charged with First Degree Possession and Sale of a Controlled Substance (mushrooms). The criminal charges carried a presumptive prison commitment of 86 months (meaning that if our client, who had no criminal history, would have been convicted of the charges, he would have gone to prison for 86 months). On the date of the offense, police officers searched our client’s entire residence without consent, probable cause, or a warrant and discovered the illegal narcotics. It was clearly an illegal search.
