Our client was charged with First Degree Controlled Substance (Sale of Cocaine) for selling a large amount of marijuana and cocaine to an undercover police officer. This was his second felony drug offense and thus he was subject to the mandatory minimum sentence of 48 months in prison. Mr. Garry challenged certain evidence in this case and litigated an evidentiary hearing where he cross-examined the undercover police officers as well as an FBI agent who was in charge of the investigation. At the last minute, Mr. Garry was able to negotiate a resolution with the prosecutor where our client pled guilty however did not receive a single day of additional jail time, and was not sentenced to an executed 48-months in prison.
